Key experience

  • Acted for various clients in arbitration proceedings, including assisting a senior Partner in two High Court references that escalated to the Court of Appeal. The transaction sought the Appeal court’s interpretation of the scope of public policy on the grounds of setting aside arbitral awards under Kenyan Jurisprudence and the major departure by the High Court from its previous decisions and policy that there exists a right of appeal to the Court of Appeal against a decision of the High Court on an application for setting aside an arbitral award under section 35 of the Arbitration Act.
  • Acted for leading banking and financial institutions in Kenya in actions against the banks for alleged breach of confidentiality, defamation and breach of banker/customer obligations. These banks included Standard Chartered Bank Ltd, Barclays Bank Ltd, Kenya Commercial Bank Ltd, National Industrial & Credit Bank Ltd, and Bank of Africa Ltd.
  • Acted for one of the country’s leading share registrars in actions filed by or against the registrar or by victims of fraud perpetrated by representatives of Central Depository Agents and other individuals.
  • Acted for several leading media houses against collecting societies claiming for royalties and damages for the infringement of copyright of the collecting societies’ members.
  • Represented several banking and financial institutions, insurance companies, private entities and individuals in both prosecuting and defending debt recovery claims. These briefs included advising clients, drawing legal opinions and successfully negotiating out-of-court settlements which are favourable to the client.
  • Involved in litigation representing the country’s Electoral and Boundaries Commission in the election petitions resulting from the 2013 general elections and assisting in rendering to the commission various advisory opinions on various aspects of electoral law.
  • Involved in several industrial claims instituted against various clients. These claims involved defending the organisations at the Industrial Court against claims arising from termination of employment and redundancies. The briefs also involved rendering advisory opinions on termination procedures and negotiating out-of-court settlements.
  • Represented several leading insurance companies in prosecuting and defending insurance claims for their insured in road traffic, industrial, occupiers and medical negligence claims.
  • Involved in litigation in respect of property claims for local authorities and private companies. These briefs included challenging the nullification of title deeds by gazettement by government departments, pursuing vacant possession of client’s appropriated properties by third parties, landlord/tenant disputes, defending local authorities and other public entities against claims arising from demolitions of unauthorised structures, and claims arising from botched land transactions and tenancy agreements.
  • Acted for several leading banking institutions seeking to exercise their statutory power of sale, including defending the institutions from any court proceedings arising therefrom.
  • Acted clients in matters before the Public Procurement Administrative Review Board in which the clients were challenging the procurement process in the award of several tenders.
