Key experience

  • Involved in an action against a leading insurance company resulting from failure to indemnify the client against loss resulting from collapse of a clinker plant where the value of the subject matter is over US$15 million.
  • Acted for one of the country’s leading share registrars in actions filed by or against the registrar by victims of fraud perpetrated by Central Depository Agents’ representatives and other individuals.
  • Acted for several leading media houses against collecting societies claiming for royalties and damages for infringement of copyright of the collecting societies’ members.
  • Acted for leading banking and financial institutions in Kenya in actions against the banks for alleged breach of confidentiality, defamation, breach of banker/customer obligations. These banks include Standard Chartered Bank Ltd, Barclays Bank Ltd, Kenya Commercial Bank Ltd and Bank of Africa.
  • Acted for several leading telecommunications and technology solutions companies in Kenya in several industrial claims instituted against them. These claims involved defending the organisations at the Industrial Court against claims arising from termination of employment and redundancies. The briefs also involved rendering advisory opinions on termination procedures and negotiating out-of-court settlements.
  • Acted for several leading banking institutions seeking to exercise their statutory powers of sale, including defending the institutions from any court challenges arising therefrom.
  • Defended the country’s Electoral and Boundaries Commission in the election petitions resulting from the 2013 general elections. The briefs included defending the electoral body in petitions challenging the elections for governor, Member of Parliament seats and County Assembly member seats.
  • Involved in litigation in respect of property claims for local authorities and private companies. These briefs included challenging the nullification of title deeds by gazettement by government departments, pursuing vacant possession for client’s appropriated properties by third parties, landlord/tenant disputes, defending local authorities and other public entities against claims arising from demolitions of unauthorised structures, and claims arising from botched land transactions and tenancy agreements.
  • Acted for several banking and financial institutions, insurance companies, private entities and individuals in both prosecuting and defending debt recovery claims. These briefs included advising clients, drawing legal opinions and successfully negotiating out-of-court settlements which are most favourable to the client.
  • Acted for several leading insurance companies in prosecuting and defending insurance claims for their insured in road traffic, industrial accident, occupiers and medical negligence claims.
